This is the last Will and Testament of me John Potts the Elder of the parish of Petham in the County of Kent, Yeoman

First I Give and devise unto my dear wife Charlotte Potts and her Asigns an annuity in yearly rent Charge a sum of twenty six pounds sterling during her life by weekly payments of ten shillings on Saturday in every week clear of all deductions The first of each payments to be made on the first Saturday After my decease And I Give to my said wife the same or the like remedy by distress for the recovery thereof as Landlords have for the recovery of rent in arrears upon Common Leases

And I Give and Devise unto my Son Thomas Potts a like annuity or yearly Rent charge or sum of twenty six pounds Sterling during his life by weekly payments of ten shillings on Saturday in every week clear of all deductions The first of such payments to be made on the first Saturday after my decease And I Give to my said Son Thomas Potts the same or the like remedy by distress for the recovery thereof as Landlords have for the recovery of Rent in arrears upon common Leases

And I hereby subject And charge my Freehold Estates hereinafter devised with the payment of the said several Annuities or yearly rent charges a sums of twenty six pounds and twenty six pounds and the remedies for recovery thereof Provided that if by reason of any Act or default of the said Thomas Potts or by operation of law the said Annuity or yearly rent charge or sum of twenty six pounds hereinbefore given and devised to him or any part thereof shall be aliened charged or disposed of to a in favor of any other person or persons then the same Annuity or yearly rent charge in the sum of twenty six pounds shall thereforth wholly cease

And I Give and Bequeath unto my said Wife Charlotte Potts and her Asigns the use and enjoyment of my Household Goods and Furniture Plate Linen and China during the term of her natural life and after her decease the same to fall into and form part of my residurary personal Estate

And I Give and Bequeath unto my son John Potts the younger the sum of twenty pounds Sterling

And I Give and Bequeath unto my Daughter Mary the Wife of Henry Smithin the sum of ten pounds sterling

And unto my Daughter Charlotte the Wife of Robert Fern the like sum of ten Pounds sterling And I direct that the said several legacies shall be vested interests in the several legacies and be paid to them on the decease of my said wife

And I Give and Bequeath the sum of One hundred and fifty pounds Sterling unto all and every the children of my said Son Thomas Potts equally to be devided between them as tenants in common And I direct that the same shall be a vested Interest in such Children immediately on my decease And shall be paid And Payable to them on the decease of the said Thomas Potts but without interest But if my said Wife shall be living at the time of his decease then the Payment thereof shall be postponed until after her death

And I subject and charge my Freehold Estate hereinafter devised with the payment of the said Legacy a sum of One hundred and fifty pounds And (subject to the payment of the said several Annuities or yearly rent charges or sums of twenty six pounds and twenty six pounds and to the remedies for the recovery thereof and to the several Legacies hereinbefore given)

I give Devise and Bequeath All and every my Freehold Messuages or Tenements Lands and Hereditaments and parts and shares of Freehold Messuages or Tenement Lands and Hereditaments and all other my real Estate whatsoever and wheresoever And also all my personal Estate of what material or Kind soever the same may consist and be at the time of my decease unto and to the use of my son George Potts his Heirs Executors Administrators and Asigns respectively for ever according to the nature and quality of the said several Estates And I give And Devise unto my said Son George Potts his Heirs and Asigns All such real Estates if any as are now vested in me as A Trustee A Mortgagee Subject to the Equities affecting the same respectively

And I appoint my said son George Potts sole Executor of this my will And lastly I hereby revoke All my former wills In Witness whereof I the said John Potts the Elder the testador have to the first two sheets of this my last Will and Testament (in three sheets of paper contained) set my Hand and to this third and last sheet Hereof my Hand and Seal the fourth day of January in the year of our Lord One thousand eight hundred and forty two.
